¿Cuándo será oficial el resultado definitivo (Presidencia de la República)?

Previsto entre 2028-12-19T23:00:00Z y 2029-02-11T22:59:59Z (UTC), confianza: estimación. The Constitutional Court proclaims the final result. Electoral law: the provisional result may be challenged 'dans un délai de deux jours après l'annonce par la Commission électorale nationale indépendante' (art. 73); with no challenge the Court proclaims 'dans les deux jours qui suivent l'expiration du délai de recours' (art. 72, as amended by Loi n° 17/013); a challenge is examined within 'sept jours à compter de la date de saisine' (art. 74, as amended by Loi n° 22/029), and once those deadlines lapse the CENI's provisional results 'sont réputés définitifs'. The final result therefore comes at most about nine days after the provisional one. The roadmap places the disputes and the Court's proclamation in 'Jan 2029' (rows 18-19) and the oath in 'Jan 2029' (row 20). Precedent: the Court proclaimed the final 2023 result on Tue 9 Jan 2024, nine days after the provisional result and 20 days after the vote (actualite.cd, 9 Jan 2024; Carter Center interim report); the oath followed on 20 Jan 2024. Window: the opening (start of 20 Dec 2028 local) is an ESTIMATED floor, two days after the earliest provisional result. The end is our ESTIMATE, erring late: the latest provisional result the roadmap allows (31 Jan 2029) plus the two-day challenge period and seven days of examination, plus two days' margin, i.e. the end of 11 Feb 2029 local. The Court's ruling is the final act, so there is no separate court-validation stage. Constitution art. 74: the President-elect takes office within ten days of the final proclamation, after taking the oath before the Court.

¿Cuándo será oficial el resultado definitivo (Asamblea Nacional)?

Previsto entre 2029-01-10T23:00:00Z y 2029-05-10T22:59:59Z (UTC), confianza: estimación. The Constitutional Court proclaims the final legislative results. Electoral law: challenges are due 'dans un délai de huit jours, dès l'annonce par la Commission électorale nationale indépendante' (art. 73); where there is no challenge, the Court proclaims 'dans les huit jours qui suivent l'expiration du délai de recours' (art. 72, as amended by Loi n° 17/013); a challenge is examined within 'deux mois à compter de la saisine' (art. 74, as amended by Loi n° 22/029), after which the provisional results 'sont réputés définitifs'. The Court's rulings are final ('ne sont susceptibles d'aucun recours', art. 74 quinquies). The roadmap places the legislative disputes in 'Jan 2029'-'Apr 2029' (row 22) and the 'Proclamation des résultats définitifs de l'élection des Députés Nationaux' in 'Apr 2029' (row 24); it installs the new National Assembly in Feb-Mar 2029 (row 23), before that proclamation. Precedent: the Court delivered its rulings on the 2023 legislative disputes on Tue 12 Mar 2024, 83 days after the vote and 59 days after the provisional results; more than 40 provisionally declared deputies were replaced (actualite.cd, 13 Mar 2024). Window: the opening (start of 11 Jan 2029 local) is an ESTIMATED floor: the earliest provisional result plus the eight-day challenge period and eight days for the proclamation. The end is our ESTIMATE, erring late: the latest provisional result in our window (28 Feb 2029), plus eight days and the two-month examination period, plus two days, i.e. the end of 10 May 2029 local. That is later than the roadmap's April. The Court's ruling is the final act, so there is no separate court-validation stage. No government stage: the President appoints the Prime Minister from the parliamentary majority (Constitution art. 78), and no statutory step forms the Government from this count.

DATE WORKING (tentative; the electorate is not convened): the CENI's Feuille de route du processus électoral 2025-2029 (Décision n° 005/CENI/AP/2025 of 4 Apr 2025, published with Communiqué n° 009/CENI/2025) schedules the 'Élections présidentielle, législative nationale et députation provinciale' for 'Dec 2028' (row 16), with the campaign Nov-Dec 2028 (row 15). The table gives the month only. The day, Saturday 16 Dec 2028, is from press reports of the decision (actualite.cd, 4 Apr 2025: 'suivie des élections combinées le 16 décembre 2028'; Radio Okapi via congoquotidien.com, 4 Apr 2025); we have not seen it in a CENI text. Electoral law (Loi n° 06/006 as amended; coordinated text 2017, art. 52 as amended by Loi n° 15/001, not changed by Loi n° 22/029): 'Le jour et l'heure de vote sont fixés par la Commission électorale nationale indépendante. Le vote, pour le scrutin direct, se tient le dimanche ou un jour férié.' 16 Dec 2028 is a Saturday, so the day would have to be declared a public holiday, or move; 20 Dec 2023 was a Wednesday. The constitution and the law set no latest polling day: Constitution art. 70, five-year term, and the outgoing President 'remains in his functions until the effective installation of the newly elected President'; art. 73 (and electoral law art. 102): the ballot is convened by the CENI 'quatre-vingt-dix jours avant l'expiration du mandat du Président en exercice'. The current term began with the oath of 20 Jan 2024, so it ends about 20 Jan 2029 and the convocation is due about 22 Oct 2028; art. 74: the President-elect takes office within ten days of the Constitutional Court's final proclamation. National deputies also serve five years (art. 103). CONSTITUTIONAL STATUS (2 Oct 2026): the Constitution (2006, revised by Loi n° 11/002 of 20 Jan 2011) is unchanged. A law setting the conditions for organising a referendum was adopted by the National Assembly on 9 Jun 2026 and by the Senate in mid-June; the Constitutional Court, in arrêt R.Const. 2695 of 28 Jul 2026, found it conforming subject to thirteen reservations; on 10 Aug 2026 the President asked Parliament to deliberate on it again (Constitution art. 137), which the National Assembly put on its September 2026 session (Assemblée nationale communiqué of 13 Aug 2026, reported by actualite.cd and ACP). No referendum has been convened and no constitutional amendment has been adopted. Constitution art. 218: a revision becomes final only by referendum or by a three-fifths vote of Parliament in Congress; art. 220: 'the number and the duration of the mandates of the President of the Republic' cannot be revised. A new constitutional text, or a delay in voter registration (roadmap: enrolment Feb-Sep 2026, still awaiting funding according to the CENI on 24 Sep 2026), could change this date. Polling hours: electoral law art. 52: 'Il a lieu de six heures à dix-sept heures'; voters present at closing get a token and vote after 17:00 ('le vote continue jusqu'au vote du dernier électeur muni du jeton'). In 2023 the CENI let polling stations that had not opened on 20 Dec open on Thu 21 Dec, 06:00-17:00 (Communiqués n° 083 and 084/CENI/2023). The DRC has two time zones and no summer time: the west, including Kinshasa, is on UTC+1 (IANA Africa/Kinshasa, '(west)' in zone.tab) and the east, including Lubumbashi and the Kivus, on UTC+2 (Africa/Lubumbashi, '(east)'). Polling closes at 17:00 local, which is 15:00 UTC in the east and 16:00 UTC in the west. pollsCloseUtc is the later of the two. The record's timezone is Africa/Kinshasa because the CENI and the Constitutional Court sit and announce in Kinshasa; all local times in these citations are Kinshasa time (UTC+1). There is no national election-night count. Each polling station posts its own result (art. 68), and the local compilation centres post partial presidential results for their city or territory (art. 70). In 2023 the CENI showed running partial presidential results on screens at its Bosolo results centre in Kinshasa from 22 Dec, two days after the vote, with the share of polling stations processed in each constituency (Carter Center interim report, 26 Jan 2024). The window runs from the last close to the end of day 3 (19 Dec 2028, local), one day past that precedent. These are partial tallies, not the provisional result.

The CENI's provisional result: its President 'rend public les résultats provisoires' (electoral law art. 71, as amended by Loi n° 22/029), which are published polling station by polling station on its website. The law sets no deadline for them. The roadmap puts 'Publication des résultats provisoires de l'élection présidentielle' in 'Jan 2029' (row 17). Precedent: by Décision n° 130/CENI/AP/2023 of 31 Dec 2023, eleven days after the 20 Dec vote, the CENI published the provisional presidential result, from 64,196 of 75,478 polling stations (Communiqué n° 086/CENI/2023, ceni.cd). The opening, the start of 18 Dec 2028 local, is an ESTIMATED floor. The window closes at the end of the roadmap's month, 31 Jan 2029 local, which is later than the 2023 timing. Provisional, not final.

The Constitutional Court proclaims the final result. Electoral law: the provisional result may be challenged 'dans un délai de deux jours après l'annonce par la Commission électorale nationale indépendante' (art. 73); with no challenge the Court proclaims 'dans les deux jours qui suivent l'expiration du délai de recours' (art. 72, as amended by Loi n° 17/013); a challenge is examined within 'sept jours à compter de la date de saisine' (art. 74, as amended by Loi n° 22/029), and once those deadlines lapse the CENI's provisional results 'sont réputés définitifs'. The CENI's provisional result for the 500 seats (electoral law art. 71); there is no national election-night count. Each polling station posts its own result (art. 68), and each constituency's compilation centre posts the local result (art. 70). The law sets no deadline. The roadmap puts 'Publication des résultats provisoires de l'élection des Députés Nationaux' in 'Jan 2029' (row 21). Precedent: the 2023 calendar planned the provisional legislative results for 3 Jan 2024, and the CENI postponed them (Communiqué n° 001/CENI/2024 of 2 Jan 2024). Décision n° 002/CENI/AP/2024 of 13 Jan 2024, 24 days after the vote, published them by constituency, except for constituencies under investigation (Communiqué n° 004/CENI/2024; Carter Center interim report: 'a 10-day delay with respect to the electoral calendar'). Results for Budjala, Bomongo, Makanza and four other constituencies followed on 4 Feb 2024 (Communiqué n° 010/CENI/2024, day 46). The opening, the start of 26 Dec 2028 local (day 10), is an ESTIMATED floor. The window closes at the end of Feb 2029 local, a month past the roadmap, as the 2023 results came by constituency over several weeks. Provisional, not final. Provincial-assembly and municipal-council elections may be held the same day; they are not profiled here.

Preguntas y respuestas
